Privacy Policy

EMART DESIGN (whose head office is located at 1341 CHEMIN DU MOULIN NEUF, 32810 ROQUELAURE, FRANCE), as controller, attaches great importance to the protection and respect of your privacy. The purpose of this policy is to inform you, in accordance with Regulation No.2016-679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the « Regulation »), my practices concerning the collection, use and sharing of information that you are required to provide us through my website. 

The purpose of this policy is to inform you about the categories of personal data that EMART Design could collect or hold on you, how the company EMART Design uses them, what the recipients of them are and with whom the company EMART Design shares them, how long the company EMART Design keeps them and how the company EMART Design protects them, and the rights you have over your personal data. 

1. The data that EMART Design collects

 By using www.emartdesign.com, you are required to provide me with information, some of which is likely to identify you and therefore constitutes personal data (hereinafter referred to as the « Data »). This is particularly the case when you complete my contact forms for a project or information request.

This information shall include the following data: 

– Made public: refers to all the information you voluntarily post on wwww.emartdesign.com such as comments on my blog.

– Navigation Data: means the data that EMART Design collects during your browsing on www.emartdesign.com such as date, time of connection and/or navigation, browser type, browser language, IP address.

When collecting the Data, you will be informed whether certain Data must be provided or optional. Data identified by an asterisk in the collection form are mandatory. Failing this, the execution of your request may be restricted.

3. Who are the recipients of this collected data and why it can be transmitted?

3.1 Data processed by EMART DESIGN

The Data collected is intended for me as the controller.

3.2 Data transferred to public authorities and/or bodies

In accordance with the regulations in force, the Data may be transmitted to the competent authorities upon request, in particular to public bodies, judicial officers, ministerial officers, bodies responsible for the collection of debts, exclusively to meet legal obligations, as well as in the case of the search for perpetrators of offences committed on the Internet. 

3.2 Data transferred to third parties

No data are transferred to a third party.

4. How long does EMART Design keep your data?

Your Data will not be retained beyond the time strictly necessary for the purposes pursued as set out in this Policy in accordance with the Regulations and applicable laws. 

In this regard, the Data used for interrogatories are retained throughout our exchange and archived after 3 months.

Data used for requests for quotations are retained throughout the contractual relationship and then archived in accordance with the limitation periods.

The Data used for my newsletter registration is kept until you wish to unsubscribe and then archived in accordance with the time limits.

When retention periods end, your Data is erased or anonymized so that it can be used without prejudice to your rights. Nevertheless, your Data may be archived beyond the time limits provided for the purposes of the investigation, detection and prosecution of criminal offences with the sole aim of making your Data available to the judicial authority as necessary. 

Archiving implies that your Data will no longer be viewed online but will be extracted and stored on a standalone and secure medium. 

5. Are your data transferred, how and where?

Your data are not transferred outside the territory of the European Union. 

6. How are your data protected?

EMART Design takes appropriate technical and organizational measures to prohibit unauthorized access or the modification, disclosure, loss or destruction of your Data.

7. What are your rights to your data?

In accordance with applicable laws and regulations relating to the protection of personal data, you enjoy a number of rights relating to your Data, namely: 

– A right of access and information: you have the right to be informed in a concise, transparent, intelligible and easily accessible way of how your Data is processed. You also have the right to obtain confirmation that any Data concerning you is processed and, if necessary, to access and obtain a copy of this Data. 

– A right to rectification: you have the right to obtain rectification of incorrect data concerning you. You also have the right to complete the incomplete data concerning you, by providing a supplementary declaration.

– A deletion right: in some cases, you have the right to have your Data deleted. However, this is not an absolute right and we may, for legal or legitimate reasons, retain this Data. 

– A right to limitation of processing: in some cases, you have the right to limitation of processing of your Data. 

– A right to data portability: you have the right to receive your Data from us in a structured, commonly used and machine-readable format for your personal use or to transmit it to a third party of your choice. This right applies only when the processing of your Data is based on your consent, on a contract and the processing is done by automated means. 

– A right to object to processing: you have the right to object at any time to the processing of your Data for processing based on our legitimate interest, a public interest mission and those for commercial prospecting purposes. This is not an absolute right and we can, for legal or legitimate reasons, refuse your application for opposition. 

– The right to withdraw your consent at any time: you can withdraw your consent to the processing of your Data when processing is based on your consent. Withdrawal of consent shall not affect the legality of treatment based on consent made prior to such withdrawal.

– Le droit de donner des directives concernant le sort de vos données après votre décès : vous avez le droit de nous donner des directives concernant l’utilisation de vos Données après votre décès.

Notez que la société EMART Design peut exiger un justificatif de votre identité pour l’exercice de ces droits. 

8. Evolutions des données ?

La société EMART Design peut être amenée à modifier occasionnellement la présente politique, afin notamment de se conformer à toutes évolutions réglementaires, jurisprudentielles, éditoriales ou techniques. Le cas échéant, la société EMART Design changera la date de « dernière mise à jour » et indiquera la date à laquelle les modifications ont été apportées. Lorsque cela est nécessaire, notamment mais pas exclusivement en cas de modification substantielle ou d’évènement particulier requérant la modification de la présente politique, nous vous informerons et/ou solliciterons votre accord. La société EMART Design vous conseille de consulter régulièrement cette page pour prendre connaissance des éventuelles modifications ou mises à jour apportées à ma politique.
